This Consumer Health Data Privacy Notice ("Notice") explains how Piqniq, Inc. ("Piqniq", "we", "us", or "our") collects, uses, and shares "consumer health data" under U.S. state consumer health data laws, including Washington's My Health My Data Act and Nevada's SB 370. It supplements our Privacy Policy and applies only to consumers covered by those laws. For everything else, please see our Privacy Policy.
Because AteMate is a health journal, much of the information you choose to add can be consumer health data.
1. Consumer Health Data We Collect
Depending on how you use the Service, we may collect the following categories of consumer health data that you choose to provide:
Information about your food and eating, including meal photos and notes.
Information about mood, hydration, movement, and sleep.
Calorie and macro information, where you use those optional features.
Health and activity data you choose to sync from Apple Health, such as steps, workouts, weight, sleep, and nutrition.
Precise location, only if you turn on location capture for your entries.
Other health or wellness details you choose to add, including anything you share with the AI Coach.
Inferences we draw from the above to surface patterns and insights for you.
We collect this information directly from you when you add it to the Service, or from Apple Health where you connect it. We collect precise location only where you have turned that feature on. We do not use bodily or biometric data for identification.
2. How We Use Consumer Health Data
We use consumer health data to:
Provide the Service, including storing your journal, generating insights, and powering the AI Coach.
Respond to your support requests.
Keep the Service secure and prevent fraud and abuse.
Comply with our legal obligations.
We do not use consumer health data for targeted advertising, and we do not sell it.
3. How and With Whom We Share Consumer Health Data
We share consumer health data only with service providers that help us run the Service, and only as needed for them to provide their service to us under contract. The categories of recipients are:
AI providers that power the AI Coach and AteMate AI.
Hosting and cloud infrastructure providers that store Service data.
Customer support and communication providers.
Analytics providers that help us understand and improve the Service.
The specific providers we currently use are listed in our Privacy Policy and are kept current there.
We may also disclose consumer health data to comply with the law, respond to lawful requests, protect the safety and rights of our users or others, or as part of a business transfer such as a merger or sale of assets.
We do not sell consumer health data, and we do not share it for targeted advertising. We do not share it for any purpose that requires your consent under applicable law without first obtaining that consent. You may withdraw your consent at any time.
4. Your Rights
If you are covered by a consumer health data law, you have the right to:
Confirm whether we are collecting, using, or sharing your consumer health data, and access that data.
Obtain a list of the third parties with which we have shared your consumer health data.
Delete your consumer health data.
Withdraw consent to our collection or sharing of your consumer health data.
To exercise these rights, contact us at privacy@atemate.com. We will respond within the time required by law. To protect your privacy, we may need to verify your identity before acting on your request. You will not be denied services or treated differently for exercising these rights. If we decline a request, you may appeal by contacting us at the same address.
5. Changes to This Notice
We may update this Notice. If we make changes, we will post the updated Notice with a new date and, where appropriate, provide a more prominent notice.
